The Quantum Creator™ Terms and Conditions
Welcome to The Quantum Creator™ digital coaching platform. These Terms and Conditions (“Agreement”) govern your use of our coaching services and platform. By enrolling in any program and accessing our coaching portal, you agree to be bound by this Agreement. Please read carefully.
1. Coaching Programs and Agreement
a. Participation in any coaching program offered by The Quantum Creator™ (“we,” “us,” or “our”) including but not limited to The Quantum Creator Small Group Coaching Cohort and Velocity Express one-on-one coaching program (“Programs”) requires a signed, completed, and returned Coaching Agreement specific to the Program you select. No access will be granted without this executed agreement.
b. Program prices are determined solely by The Quantum Creator™ and are non-negotiable, unless specific approval has been granted by Beth Raebeck Hall and The Quantum Creator™. Payment must be received in full prior to accessing any Program materials or coaching portal.b. P Payment must be received in full prior to accessing any Program materials or coaching portal.
c. Accepted payment methods will be processed exclusively through approved third-party commerce sites designated by The Quantum Creator™. Payments may be made in one or two installments as indicated in your Coaching Agreement. Access to the coaching portal requires full payment clearance and a signed Coaching Agreement.
2. Client Access and Security
a. Access credentials to The Quantum Creator™ coaching portal are provided exclusively to the registered client. Clients may not share login information or grant access to non-clients under any circumstances. Unauthorized sharing constitutes a breach of this Agreement and may result in immediate termination of access without refund.
b. Clients are responsible for maintaining the confidentiality of their login details and for all activities conducted through their accounts.
3. Intellectual Property and Proprietary Rights
a. All content, materials, methodologies, and intellectual property provided through The Quantum Creator™ Programs and Platform, including but not limited to digital files, training modules, written materials, recordings, and coaching content (collectively “Materials”), are the exclusive property of Beth Raebeck Hall and The Quantum Creator™.
b. These Materials are protected by copyright and other applicable intellectual property laws. Clients are strictly prohibited from copying, reproducing, distributing, displaying, or creating derivative works of any Materials in whole or in part without prior written authorization from Beth Raebeck Hall and The Quantum Creator™.
c. Unauthorized use of any proprietary content may result in legal action and immediate termination of access to all Programs without refund.
4.Client Responsibilities and Conduct
a. Clients agree to engage in the Programs professionally and respectfully. The Quantum Creator™ reserves the right to remove or refuse service to any client whose behavior is disruptive, disrespectful, or otherwise violates community standards as defined in the Coaching Agreement.
b. Clients understand that coaching is not therapy and agree to seek independent professional advice for mental health, legal, financial, or medical matters.
c. It is the client’s responsibility to attend scheduled coaching sessions. Participation in post- session exercises, other recommended activities and materials is the decision of the client. Client may choose to utilize included materials and worksheets, or not.
5. Refunds and Cancellations
a. All payments are final and non-refundable once access to the coaching portal or program commencement has occurred, except as required by law or stated in a separate refund policy provided with your Coaching Agreement.
6. Governing Law
Governing Law and Dispute Resolution.
a. This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction where The Quantum Creator™ is principally based.
b. Any disputes arising hereunder shall be resolved in the appropriate court or arbitration forum in said jurisdiction.
7. Modifications
The Quantum Creator™ reserves the right to update or modify these Terms and Conditions at any time with notice provided to clients. Continued use of the platform after modifications constitutes acceptance of the updated terms.
This Terms and Conditions policy is designed to ensure compliance with 2025 best practices for digital coaching platforms, protecting both The Quantum Creator™ and its clients with clear requirements for signed agreements, payment, access control, and intellectual property rights. It integrates industry standard legal language for enforceability and clarity.
The Quantum Creator™ and its affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of Client’s participation in the Program.
